Default 2005 Cube3 Transmission Sticks in 1st gear

I am driving a Japanese 2005 Cube3 with less than 60,000 miles (95,000km) on it. This happens at random (about ten times in a two month period) but from a stop there are times the transmission will stick in 1st gear and the only way I have found to consistently get it to correct itself is to shut the car off and back on.

I have found that I can just shift to neutral, shut the car off, start it while rolling, and shift back in to drive to fix it as well (I know not the safest idea).

I have only gotten it corrected once without shutting the car off. I was in traffic and had to keep moving so, the engine was rev'd at over 4000 rpm and then it shifted on its own. I have not been able to replicate this.

I have tried to manually shift to 2nd or Low and back to drive and it does not fix it. The error usually happens only when starting from a complete stop but has happened once from a slow roll. The transmission got "confused" and shifted down to first and stuck in that gear. Again, had to be shut off to correct it.

I have had the tranny fluid flushed and it is now nice and red but this is still happening. I am planning to drop the pad and replace the filter also but, I have a feeling this is something electronic.

The "shift speed sensor" has been changed as well but did not correct the issue. This is the small sensor you can see from the top and was replaced with a used sensor. (I am in the military, stationed in Okinawa- not looking to spend a ton on something I paid $1500 for)

What else should I look at before trying to find a used replacement transmission?
